At Rurgam Foundation (Pvt. Ltd.), we recognize that privacy is a fundamental right, and we are committed to safeguarding it. We collect and process certain user data. We understand that you care about how your personal information is used and shared, and we deeply appreciate your trust in us to handle it responsibly and with care. This privacy policy outlines how rurgam.org manages your personal information. It applies to all use of the Rurgam platform and related services, regardless of how you access them (including via mobile devices), wherever this Privacy Policy is referenced. Please read this privacy policy alongside our Terms of Use, as the definitions provided in the Terms of Use also apply here unless otherwise defined.

This privacy policy constitutes a legally binding agreement between you and the Rurgam Foundation (Pvt. Ltd.). By accessing or using the platform in any way, you agree to the terms outlined herein. Please note that your data may also be collected by our affiliates outside of the platform, such as through in-person meetings, participation in conferences, or engagement with forums, promotional materials, and other activities. To enhance our services and outreach, we may integrate data technologies into our platform, which may gather information from additional sources. Rest assured, we take every reasonable measure to secure the data we collect. Please read this privacy policy document along with the Terms of Use carefully before you access our platform to fully understand what we do. If you do not agree or fully understand the Terms of Use and/or our Privacy Policy, please do not use the platform. You hereby provide your unconditional consent or agreements to Rurgam as provided under sections 43A and 72A of the Information Technology Act, 2000.

1. Personal Information

We may ask you to provide certain information that may be general or personally identifiable information that can be used to contact or identify you, including various types of data as categorised herein (personal information). Where possible, we may indicate which fields are required and which fields are optional. We use your personal information for legitimate interests to further our prospects. Please note that by using or accessing this website, you consent to the terms of disclosure of information, including personal information, as per the privacy policy.

A campaign run by a third party on the platform is self-verified and fully verified. Donors are encouraged to ask questions and independently evaluate the validity of any campaign. By donating, donors acknowledge that they have performed their due diligence and rely entirely on Rurgam for the accuracy or completeness of the information provided. Furthermore, Rurgam or its employees guarantee that the beneficiaries will use the donated resources as intended. Rurgam is a direct party to any campaign. The personal information we collect includes your name, address, phone number, email address, date of birth, gender, and Regulation 3 of the Information Technology (Fair Practices and Processing and Sensitive Information Personal Data) Regulations, 2011. We use this information to provide our services, process payments, communicate with you, update our records, and maintain your transaction history. This helps us improve the platform, detect and prevent fraud, and allow third parties to perform technical, logistical, or other functions on our behalf. To help you better understand the types of information we collect, we’ve categorised the data we gather.

Please note that the following list is not exhaustive but provides an overview:

Contact Information: We collect and store any information you provide through the website or by any other means. You have the option to withhold certain details based on your preferences. The contact information we may gather includes, but is not limited to, your name, photograph, address, phone number, date of birth, gender, email address, financial details, social media profile (if applicable), and contacts.

Personalized Information: Based on your interactions with us, particularly as a third-party beneficiary, we may request and receive information related to your campaigns for onboarding on the platform. This may include a personal statement, including your medical records, the purpose and objectives of the campaign, and your financial details. We may also collect photographs of you, people associated with you, or places associated with the campaign. This information may be used to market the campaign and help increase resources for beneficiaries to meet campaign goals. This may include sharing such details with social media, third-party websites, and service providers who work with us.

Transaction and Technical Information: We collect and store certain types of information whenever you interact with us, whether through emails, visits to the Portal, or phone communication. This may include details such as your location, address, browser type and version, the pages you visit on our site, the date and time of your visit, the duration of your visit, and other statistics, including the IP address of your device and your transaction history. We may use this data for internal analysis, to offer location-based services, and to provide more personalized experiences.

Third-Party Data: We may receive information about you from external sources and incorporate it into our user database. By using or continuing to use the platform, you consent to our use of your information (including sensitive personal information) by this privacy policy, which Rurgam may update at its discretion. You also agree to and consent to our collection, storage, processing, transfer, and sharing of your information (including sensitive personal information) with third parties or service providers for the purposes outlined in this Privacy Policy.

Financial Data: When you donate through our platform, payments are processed via the payment gateway options available. Your preferred payment method may be saved for future use. If you allow us to retain partial details of your credit/debit card, authorized payment account, or preferred UPI information, we may do so to provide a more personalized experience. Additionally, we store the complete financial details of the trusts associated with us, including account numbers, SWIFT/IFSC codes, and any other financial information required by applicable law.

Other Data: Depending on your interaction with us, we may request additional information necessary to provide our services. We also collect, use, and share aggregated data, such as statistical or demographic information, for internal purposes. In certain cases, we may be required to share this information with government authorities for identity verification or to assist in the prevention, detection, or investigation of incidents, including cyber incidents or legal offences. By using our services, you consent to Rurgam disclosing your information when required by law. 

You acknowledge that we use this information to deliver our services, which may involve displaying or sharing certain details on our platform for public viewing or with third parties. If you prefer to remain anonymous, you may request this by contacting us via our helpline, email, or reaching out to our grievance officer as listed in Paragraph 8 below. While anonymity prevents the public display of your information, we may still collect and use such data internally.

Please note that we do not collect sensitive personal data, such as information about your race, ethnicity, religion, sexual orientation, political views, trade union membership, or criminal history. However, choosing not to provide certain information or restricting its display may affect your access to the platform and our services.

2. Official Third-Party Activities

Rurgam works as a social for the beneficiaries for their needs and better social community improvement. We facilitate the connection between donors and partner trusts so that donations can be directed to the content that beneficiaries need. We provide links to third-party websites as a convenience to you, but the inclusion of any link does not imply endorsement by Rurgum. Access to any linked website is at your own risk, and RURGUM is not involved in the transactions between you and these sites. Your use of any linked website is governed by its terms and conditions.

Rurgam may also display third-party advertisements. The nature of these advertisements does not imply endorsement or recommendation of the advertisers or their products and services. For advertising details, please refer directly to the advertiser. Rurgam is not responsible for interactions with third parties and disclaims any liability related to such interactions. We collect, maintain, and process personal information as necessary for our legitimate business interests, such as managing relationships, fulfilling needs, and performing administrative functions. This may include using contact management, analytics, and marketing tools.

Personal data, including cookies (detailed in paragraph 4), may be shared with service providers that assist us with web analytics, advertising, email delivery, and other functions. These companies are limited to using your data for their contracted services. To comply with legal obligations, we may also share personal information with applicable trusts. In addition, we may share personal information with our group companies for business functions and internal analysis. Some of these companies or service providers may be located in regions with different privacy or data protection standards. We ensure that appropriate security measures are in place in accordance with applicable laws and our policies.

We may process personal information for contractual purposes or on a consent basis for specific purposes. Unaffiliated third parties that provide content, functionality, and services on our web and social media sites may collect and use personal data in ways that we do not control. We are not responsible for the privacy practices of these third parties, although some user controls may be available through Internet browsers or apps.

5. Right to unsubscribe

You have the option to withhold information by choosing not to use the platform or specific features where opt-out options are available. We may use technology to retain your preferences automatically. When you update your information, we typically keep a copy of the previous version for our records. If you prefer not to receive updates from us, you can adjust your preferences or contact us at info@rurgam.org. Please note that opting out of updates does not alter your use of the platform, which remains governed by the Terms of Use and Privacy Policy.

Additionally, you can adjust settings for browser add-ons, like Flash cookies, by visiting the add-on’s website or changing its settings. 6. Data Retention of Information

We will retain your data only as long as necessary to fulfill the purposes for which it was collected, including meeting any legal, accounting, or reporting obligations. To determine the appropriate retention period, we consider factors such as the amount, nature, and sensitivity of the data, the risk of harm from unauthorized use or disclosure, the purposes of the processing, and whether these purposes can be achieved through other means, as well as applicable legal requirements. In some cases, we may anonymize your data for research or statistical purposes, in which case it may be used indefinitely without further notice to you. The personal and contact information of donors and beneficiaries provided to Rurgam is processed, stored, and retained securely on our servers. Our web hosts and the agency managing your information adhere to IS/ISO/IEC 27001 standards or an equivalent, ensuring compliance with security techniques and information security management system requirements.

7. Persons allowed to Use Rurgam

Access to Rurgam is restricted to Indian passport holders who are capable of entering into a legally binding contract under the Indian Contract Act of 1872. If you are a minor (under the age of 18), you may use Rurgam only with the involvement of a parent or guardian. We do not knowingly collect or store personal data of children unless legally permitted or provided in cases where a child is a beneficiary of a campaign.

8. Removal of Information/Account Deactivation

Users can review and update the information provided to Rurgam during registration or at any time thereafter by signing into their account and making the necessary changes. We offer all users the option to opt out of receiving non-essential communications, such as promotional or marketing-related messages, from us or on behalf of our campaigners after setting up an account. Users can also cancel their accounts and inform us if they wish to discontinue using our services. If you wish to deactivate your account or remove your contact information from all Rurgam.org lists and newsletters, please contact us at info@rurgam.org .

9. Security Breach & Precautions

Our platform implements stringent security measures to protect against the loss, misuse, and alteration of the information under our control. When you access or update your account information, we provide the use of a secure server. Once your information is in our possession, we follow strict security protocols to safeguard it from unauthorized access. Our web hosts, transaction affiliates, and other partners employ industry-grade and standardized methods to protect your data from misuse.

If you believe that your data, which we do not share with third parties, has been compromised or if there has been a security breach due to a cybersecurity incident, please contact us immediately using the details provided below. We will take appropriate steps to rectify the breach and notify the relevant authorities about the incident.

To report abuse on the platform that is not related to a cybersecurity incident, users can click on the “Report Abuse” tab located at the bottom of the page and provide details of the issue. Upon receiving this information, Rurgam will investigate the matter and take the necessary steps to address it.

10. Advertisements on Rurgam.org

We may use third-party advertising technologies to deliver relevant content and ads both on our platform and on other websites you visit. These advertisements may be tailored based on various factors, such as the content of the page you are viewing, the information you provide (e.g., age and gender), your searches, demographic data, user-generated content, and other details we collect from you. The ads might reflect your current activities or your behaviour over time and across different websites and online services. 

Additionally, third parties whose products or services are featured on our platform may place cookies or other tracking technologies on your devices to gather information about your usage. We also allow other third parties, including ad networks and servers (e.g., Google Analytics, DoubleClick), to display customized ads on our site, other sites, and within applications. These third parties may access their tracking technologies and use customer information (such as hashed email addresses) to target or retarget ads to you on other websites and mobile apps. You can opt out of many of these services as described below.

11. Your Consent

By using our website and/or by providing your information, you consent to the collection and use of the information you disclose on the platform by this privacy policy, including but not limited to your consent for sharing your information as per this privacy policy. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. The donors/contributors hereby permit Rurgam to share their personal information, such as name, email address, and contact information, with the respective donors, campaigners, and beneficiaries of the donations made by the donors via rurgam.org. By continuing to the next step, you are willingly permitting Rurgam to contact you via WhatsApp, email, SMS, and other modes of communication.

12. Grievances

Rurgam is committed to addressing donor concerns promptly. If you have a grievance, you may report it to our grievance officer, who will work to resolve the issue within 30 days from the date of receipt. Rurgam has established an in-house legal counsel department for this purpose.
